This is an application for grant of anticipatory bail in connection with Mansi PS case no. 132 of 2022, registered for the offences punishable under Sections 406, 409/34 of the Indian Penal Code.
The allegation is regarding 08 bags of rice, which was kept in the School for the purposes of preparing meal for the children, having been mis-appropriated by the accused persons including the petitioner herein. The learned counsel for the petitioner submits that the petitioner is innocent, he has been falsely implicated in the present case and is having a clean antecedent. The learned

No.16186 of 2023(2) dt.19-05-2023 2/3 counsel for the petitioner has further submitted that the Principal of the School in question has already been granted the privilege of anticipatory bail by the learned court below, however, in order to show his bonafide, the petitioner is ready to deposit a sum of Rs. 10,000/- with the Nazarat of the learned civil court at Khagaria, subject to the final outcome of the case in question.
Per contra, the learned APP for the State has vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the parties and taking into account the materials available on record, this Court deems it fit and appropriate to admit the petitioner to the privilege of anticipatory bail, however subject to him producing receipt of deposit of a sum of Rs. 10,000/- with the Nazarat of the learned civil court at Khagaria, before the learned court below, within a period of four weeks from today.
Accordingly, the abovenamed petitioner, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, is directed to be released on anticipatory

Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Khagaria in connection with Mansi PS case no. 132 of 2022, subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
