JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-09-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offences punishable under Sections 302/34 and other allied sections of the Indian Penal Code.

As per the prosecution case, this petitioner and other accused persons committed murder of the father-in-law of the informant.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He submits that though informant claims herself to be eye witness but she came to the place of occurrence after commission of incident. There is general and omnibus allegation against the petitioner and 13 other accused persons named in the FIR and post mortem report does not support the allegation. Petitioner claims

Learned counsel for the State opposes the prayer for bail submitting that during investigation witnesses have supported the prosecution case. In the post mortem report doctor has opined that death caused due to hemorrhage and shock as a result of fatal injury.

Considering the specific allegation against the petitioner, his prayer for bail is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice. (Prabhat Kumar Singh, J) shashi/- U T
