JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2020 Heard learned counsel appearing on behalf of the petitioner, learned counsel appearing on behalf of the State as well as learned senior counsel appearing on behalf of the Economic Offence Unit.
The petitioner is apprehending arrest in connection with Economic Offence P.S. Case No. 09 of 2012 for offences under Sections 403, 406, 409, 420, 465, 468, 471 and 120B of the Indian Penal Code and Sections 13(1(D), Amendment Section 13(1)(A) read with Section 13(2) of the Prevention of Corruption Act.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.17593 of 2020(2) dt.10-07-2020 2/2 petitioner, who is aged about 72 years, has no criminal antecedent and he retired way back in 2009. He further submits that co-accused, namely, Sharma Pandey has been granted anticipatory bail by a Bench of this Court vide order dated 24.03.2014 passed in Cr. Misc. No. 4436 of 2014. Considering the fact that the petitioner is aged about 72 years, he retired way back in 2009 and that co-accused, namely, Sharma Pandey has been granted anticipatory bail by a Bench of this Court, this Court is inclined to grant bail to the petitioner. Let petitioner, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 1,00,000/- (Rupees one lakh) each with two sureties of the like amount each to the satisfaction of P.O. (Spl.), Economic Offences, Muzaffarpur in connection with Economic Offence P.S. Case No. 09 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
