The petitioner apprehends his arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code and Section 27 of the Arms Act.

On account of land dispute between the agnates, it is alleged that on the order given by co-accused Baijnath Ray, other co-accused persons resorted to firing, as a result of which, the informant and his grand daughter sustained gun-shot injury. It is submitted on behalf of petitioner that specific allegation of causing gun shot injury is against other co-accused persons. So far as this petitioner is concerned, there is general and omnibus allegation. Both parties are own gotiya and land dispute is going on between them and due to said land dispute, the alleged occurrence took place. Co-accused Baijnath Ray has

Patna High Court CR. MISC. No.16512 of 2023(3) dt.22-06-2023 2/2 already been granted regular bail by a coordinate Bench, vide order dated 14.11.2022 passed in Cr.Misc. No. 40937 of 2022. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - III, Samastipur in connection with Sarairanjan P.S.
