JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-05-2019 This is an application for grant of anticipatory bail in connection with Simri P.S. Case No. 79 of 2007, disclosing offences under Sections 304(B), 201, 34 of the Indian Penal Code.

Allegation against the petitioner is of dowry death of the deceased.

Submission of learned counsel for the petitioner is that he is co-villager of the husband of the deceased and police after investigation submitted final form against the petitioner not finding the case true, however, later on cognizance has been taken and warrant of arrest has been issued in the year 2018 against the petitioner and he has no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides, considering the above

Patna High Court CR. MISC. No.18459 of 2019(3) dt.06-05-2019 2/2 submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar, in connection with Simri P.S. Case No. 79 of 2007, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
