The petitioner has preferred this application for grant of regular bail in a case registered under sections 399, 402 and 414 of the Indian Penal Code, under sections 25(1-B)(a), 26 and 35 of the Arms Act and sections 20 and 22 of the N.D.P.S. Act. As per the prosecution case, on a raid being conducted, narcotic substance as also arms and ammunitions were recovered from the accused persons. It is stated that from possession of the petitioner, a motorcycle without registration number plate, a loaded country made pistol and a live cartridge were recovered.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from
Patna High Court CR. MISC. No.26922 of 2021(3) dt.23-11-2021 2/2 petitioner's possession and he has been falsely implicated in the case. He is in custody since 19.12.2020 and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 11 months, the Court directs the petitioner to be enlarged on bail in connection with N.D.P.S Case no.71 of 2020 (arising out of Ghorasahan P.S. Case no.477 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge/Special Judge, East Champaran, Motihari.
