Petitioners are apprehending their arrest in a case registered for the offences punishable under Section 323, 341, 354A, 452, 504, 506, 34 of the Indian Penal Code and Section 3(1)(xi) of the SC & ST (Prevention of Atrocities) Act. The prosecution case is that the petitioners assaulted with lathi to the informant, brother-in-law and relative of the informant when they objected petitioner No. 1 to scuffle with the sister of the informant.

It is submitted by learned counsel for the petitioners that it is a simple case of scuffle when the injury has been found to be superficial, simple in nature. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

No.24000 of 2015 (2) dt.10-07-2015 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender within a period of six weeks in connection with Kinjar P.S. Case No. 17 of 2015, pending in the Court of learned Chief Judicial Magistrate, Jehanabad. With the observations above, the application stands disposed off.
