The petitioners, Monu Kumar Singh @ Monu Kumar, Apee Kumar Singh @ Apee Singh and Sanjay Singh @ Sanjay Kumar Singh apprehend their arrest in Rasulpur P.S. case No. 20 of 2016 under Section 307 and other sections of the Indian Penal Code.
The informant alleged that Apee Singh and Niraj Singh assaulted him with Lathi and fists and slaps. Thereafter, other accused persons, having armed with different weapons, came and assaulted his family members. Rahul Kumar Singh assaulted Ratnesh Kumar Singh with Farsa on his ear. It is submitted that petitioner Apee Singh and Niraj Singh are alleged to have assaulted the informant, J. P. Singh, but J. P. Singh has received one abrasion on his left fore arm, which is simple in nature. There is specific allegation against Rahul Singh
Patna High Court Cr.Misc. No.20754 of 2016 (3) dt.19-07-2016 2/2 that he assaulted Ratnesh Kumar Singh but Rahul Singh is not the petitioner here. Ratnesh Kuamr Singh got grievous injury on his ear.
The learned counsel for the informant as well as the learned Additional Public Prosecutor did not dispute this fact and submits that except Ratnesh Kumar Singh other injured got simple injuries. There is counter version being Rasulpur P.S. case No. 21 of 2016.
Considering the facts aforesaid and the fact that there is case and counter case and on account of assault made by the petitioners simple injuries were caused to the informant and others, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-X, Saran at Chapra in Rasulpur P.S. Case No. 20 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
