====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 10-02-2015 Heard both sides.

The petitioners, namely, Janardan Mandal and Bikash Mandal @ Bablu, apprehend their arrest in Forbisganj P.S. Case No. 115 of 2011 (G.R. No. 543/2011) registered under Sections 364/34 of the Indian Penal Code.

The informant made allegation that the petitioners and others kidnapped his son Rakesh Kumar Verma. Learned counsel for the petitioners submits that the petitioners are innocent. The informant is not the eye witness of the occurrence and, on mere suspicion, the name of the petitioner figured in the case.

On perusal of the record, it appears that during the course of investigation, many witnesses have disclosed that the

Patna High Court Cr.Misc. No.34180 of 2014 (2) dt.10-02-2015 2/2 petitioners and others kidnapped the son of the informant. Considering the facts aforesaid, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.
