JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468, 471 and 120B of the Indian Penal Code.
Prosecution case is that the informant purchased a Scorpio vehicle after getting it financed from Mahindra and Mahindra Finance. The informant was making repayment of loan amount in monthly installment of Rs.25,000/-. Subsequently, coaccused Abhimanu Singh took the vehicle from the informant on assurance of making payment of the installment amount regularly but he sold the vehicle to the petitioner.
It is submitted by learned counsel for the petitioner that the petitioner was not aware about the ownership of the vehicle. But as soon as he came to know he got his money back and returned the
Patna High Court Cr.Misc. No.20433 of 2016 (2) dt.12-05-2016 2/2 vehicle to co-accused Abhimanu Singh. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the thrust of accusation against co-accused Abhimanu Singh, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 9th ACJM, Saran at Chapra, in connection with Jalalpur P.S. Case No.5/2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
