JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-03-2019 This modification application has been filed for modification of order dated 28.05.2015 passed in Cr. Misc. No.15583 of 2015 by which the petitioners were granted anticipatory bail with condition to surrender within a period of four weeks from the date of receipt of the order. Submission of learned counsel for the petitioners is that they are living outside the State for earning their livelihood, therefore they could not surrender within time, as such this modification application has been filed by them. Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances of the case, I am not inclined to interfere in the

Patna High Court CR. MISC. No.15220 of 2019(2) dt.12-03-2019 2/2 order dated 28.05.2015. However, if the petitioners surrender before the court below and make prayer for regular bail, same shall be considered on its own merit and also considering the fact that they have earlier granted anticipatory bail and could not appear before the court below.

With the above observation, this modification application is disposed of.
