JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-07-2015 Heard learned counsels for the petitioner and the State. The petitioner being the then Block Development Officer is apprehending arrest in a case registered for the offences punishable under Sections 406, 420 and 120B of the Indian Penal Code.

It is alleged that the petitioner being the BDO of the Jokihat Block was given advance of `48,13,900/- for distribution of old age pension under Social Security Scheme but the petitioner failed to give account and thereby misappropriated `51,300/- It is submitted by learned counsel for the petitioner that the petitioner undertakes to deposit alleged amount of `51,300/- before learned court below which will be invested in some fix deposit scheme in connection with the present case which will be subject to the result of the present case.

Patna High Court Cr.Misc. No.24785 of 2015 (2) dt.10-07-2015 2/2 On deposit of 50% of alleged amount, let the above named petitioner be released on provisional anticipatory bail for three months, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Araria in connection with Jokihat P.S. Case No. 293 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The provisional bail of the petitioner will be confirmed by the learned court below on deposit of entire alleged amount i.e., `51,300/- within a period of three months.
