JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-09-2017 The petitioners seek regular bail in connection with Chandramandih P.S. Case No. 61 of 2017, registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a), and 47 of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 390 litres of country made liquor.

It has been submitted on behalf of the petitioners that they have falsely been implicated in this and in fact nothing has been recovered from their conscious possession and they have no criminal antecedent and have been in judicial custody since 03.07.2017.

Having heard both sides, considering the facts and circumstances of the case coupled with the fact that in this case huge quantity of liquor has been recovered, as such, at this stage, I am not inclined to release the petitioner on bail rather this application is disposed of with the direction to the court below to release the petitioners to his own satisfaction once charge is framed in this case or if petitioners complete further period of one month in judicial custody, whichever is earlier.
