The petitioner has preferred this application for grant of regular bail in a case registered u/s 302 and 304B read with 34 of the Indian Penal Code.

As per the prosecution case, the co-accused person was married to the informant's daughter. After marriage, the petitioner and her in-laws used to assault and abuse the deceased for the sake of dowry and they murdered the informant's daughter due to non-fulfillment of the said dowry.

Patna High Court CR. MISC. No.15969 of 2022(6) dt.27-09-2022 2/3 Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Charge-sheet has already been submitted against the petitioner under section 306 of the I.P.C. The petitioner is not named in the F.I.R. and the name of the petitioner has sprung up during the course of investigation. The petitioner is accused in one more criminal case in which he is on bail as stated in para 3 of the bail petition. The petitioner is in custody since 12.10.2021.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that it is the petitioner who was in touch with the deceased and had made obscene video and blackmailed the deceased on account of which she committed suicide. It is further submitted that previously the husband of the deceased had also lodged a case against the petitioner for abducting the deceased, Lakshmi Devi. There is specific allegation against the petitioner who compelled the deceased to commit suicide.

Considering the aforesaid facts and circumstances of the case as well as the specific allegation against the petitioner, I am not inclined to enlarge this petitioner above-named on bail. Learned Trial Court is directed to expedite the trial
