2. The petitioner apprehends his arrest in connection with Dariyapur P.S. Case No. 14 of 2023 for the offence registered under section 394 of the Indian Penal Code and section 27 of the Arms Act lodged on 13.01.2023 by the informant, Surendra Ram.
3. As per the prosecution story, the informant alleged that he was running a Customer Care Centre and was going to Bank of Baroda, Dighwara with a cash of Rs. 2,14,000/- when the accused persons came, opened fire and snatched the bag, he was shifted to hospital and the F.I.R.
4. Learned Counsel for the petitioner submits that Yash Kumar Mishra was arrested and on his confessional
Patna High Court CR. MISC. No.22963 of 2024(3) dt.19-07-2024 2/2 statement, the name of the petitioner cropped up which resulted into his implication.
5. Learned APP for the State, on the other hand, opposes the prayer for anticipatory bail submits that there is not only allegation of robbery, the accused opened fire, causing injury to the informant who ultimately was rushed to the All India Institute of Medical Sciences, Patna.
6. This is an anticipatory bail, the name of the petitioner has cropped up in the confessional statement of Yash Kumar Mishra.
7. The incident is of January, 2023 and a year later, the anticipatory bail application has been filed which is accordingly rejected.
