1. Heard Mr. Ramchandra Sahni, learned counsel for the petitioner and Mr. Binod Kumar No.3, learned APP for the State.
2. The petitioner seeks regular bail in connection with Barharia P.S. Case No. 26 of 2023 dated 23.01.2023 registered for the offence(s) punishable under Sections 302, 120B/34 of the Indian Penal Code.

The main submissions advanced by the petitioner's counsel are that the petitioner is a lady aged about 50 years and in the entire FIR, only suspicion has been raised by the informant who is admittedly not an eyewitness of the alleged occurrence. It is further submitted that as per the allegation, the informant, son of the deceased got an information on his mobile phone from his uncle that his father had been murdered by

No.19585 of 2025(2) dt.22-04-2025 2/3 stabbing and then he rushed to the poultry farm (place of occurrence) and saw his father in injured condition who told him that four persons covering their faces stabbed him, so, from this part of the prosecution's story, it is clearly evident that the petitioner is not alleged to be present at the alleged place of occurrence and in the second part of the prosecution story, the informant raised suspicion as to petitioner's involvement in the alleged crime of murder mainly on account of a land dispute running in between both the parties at that time and also, due to previous threats allegedly made by this petitioner and her daughter namely, Anjali Kumari but regarding the said threatening, no legal action had been initiated by the prosecution party prior to the commission of the alleged occurrence. It is lastly submitted that the petitioner has been languishing in jail since 11.01.2025 having fair and clean antecedent and against her, investigation has been completed and there is no direct evidence against her.
4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.
5. In the facts and circumstances of the case as well as considering the aforesaid submissions mainly the facts that as per the FIR, there is no direct evidence against the petitioner

No.19585 of 2025(2) dt.22-04-2025 3/3 showing her involvement in the alleged crime of murder and mainly on the basis of suspicion as well as previous threats allegedly made by her to the deceased, she has been made accused but the petitioner has taken plea that regarding the said previous threats, no legal action was initiated and also coupled with the completion of investigation against this petitioner, this court is inclined to grant the relief of bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Barharia P.S. Case No. 26 of 2023 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
