JUSTICE SANJAY PRIYA ORAL ORDER 09-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Paharpur P.S. Case No. 29 of 2017 instituted for the offence under Sections-420, 406, 506 of the Indian Penal Code.
It has been submitted that the petitioner has clean antecedent. He is in custody since 08-05-2017. He was care taker of the Aircel Tower whereas; the informant was the manager of the aforesaid tower. All the alleged articles were under the care and custody of the informant and key of store room of the alleged things always remained in possession of the informant. The case has been filed on 03-02-2017 whereas the alleged occurrence has taken place on 22-10-2016 and there is no explanation of delay in filing the case. There is no recovery of any incriminating articles from possession of the petitioner. He has been made accused merely due to business politics. In this manner, from the written report, it appears that mere vague allegation has been made against the petitioner. In such circumstances, prayer for bail is allowed. The petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Paharpur P.S. Case No. 29 of 2017 to the satisfaction of learned Chief Judicial Magistrate, Motihari subject to condition that both the bailors should be close relative of the petitioner.
