2. The petitioner seeks bail in connection with Special (NDPS) Case No. 278 of 2023 arising out of Bahadurpur P.S. Case No. 390 of 2023 registered for the offence punishable under Sections 21/22 of the N.D.P.S. Act.

3. As per the prosecution case, total 4.8132 grams of Buprenorphine Injunction (Morphine) has been recovered from the accused persons.

4. It has been submitted by learned counsel for the petitioner that there is no recovery from the petitioner and the petitioner is in jail since 13.10.2023. He has been named in the confession of co-accused Abhishek Agrawal @ Abhishek Kumar, who has been granted vide order dated 24.01.2024 in Cr.

Patna High Court CR. MISC. No.19375 of 2024(3) dt.19-04-2024 2/2 Misc. No. 2650 of 2024. Similarly, situated co-accused namely, Om Prakash Lal has also been granted bail by this Court vide order dated 10.04.2024 in Cr. Misc. No. 18904 of 2024. The petitioner is in jail since 13.10.2023 having clean antecedent.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special (NDPS) Court No.1, Patna in connection with Special (NDPS) Case No. 278 of 2023 arising out of Bahadurpur P.S. Case No. 390 of 2023.

8. The petitioner will also mark attendance in Hilsa Police Station, Nalanda on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) P. Kumar U T
