Petitioner is apprehending arrest in connection with Laukahi P.S. Case No. 235 of 2019 for the offence under sections 409, 420, 467, 120B of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has no criminal antecedent.
Allegation against this petitioner is that he has illegally appointed Punita Kumari on the post of Panchayat Teacher on 7.2.2014 ignoring the provision of mandatory rules for appointment on the post of panchayat teacher. Learned counsel further submits that in view of order passed in C.W.J.C. No. 16749 of 2012 the appointment letter was issued to Punita Kumar under the signature of the
Patna High Court CR. MISC. No.14245 of 2020(2) dt.03-07-2020 2/2 petitioner as Punita Kumari approached the Court in C.W.J.C. No. 16749 of 2012 and direction was given in favour of the petitioner by the writ Court. Thereafter, the service of Punita Kumari was dismissed and by the order of the writ Court in C.W.J.C. No. 14962 of 2019 her removal was stayed. Considering the aforesaid, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Jhanjharpur, Madhubani, in connection with Laukahi P.S. Case No. 235 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C. (Anil Kumar Upadhyay, J) Ravi/- U T
