Counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of eight weeks.

The petitioner seeks bail in connection with S.Tr. No.96/15 arising out of Sonebarsa P.S. case No.98/14 registered under Section 302 of the Indian Penal Code, pending in the court of 8th Additional Sessions Judge, Sitamarhi. The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application taking into account that the petitioner is the assailant. A report was called for from the trial court. It has been reported that out of six prosecution witnesses, five prosecution

Patna High Court CR. MISC. No.27407 of 2021(3) dt.29-09-2021 2/2 witnesses have already been examined and only one witness is yet to be examined and the trial is expected to be concluded within a period of three months.

Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected.

The Trial Court is directed to take all necessary steps to conclude the trial at the earliest.
