This application for grant of anticipatory bail arises out of Narari Kala Khurd P.S. Case No. 05 of 2016, disclosing offences under Sections 353,427/34 of the Indian Penal Code.

The petitioners are employees of South Bihar Power Distribution Company Limited. In response to a call given by a body of an employees' Association, employees of the Board were on strike. It is alleged against the petitioners that they damaged certain electric poles and Hexa Blades were found which are used to cut the conductor.

Learned counsel appearing on behalf of the petitioners has submitted that the petitioners have been named in the First Information Report only on the basis of information received by the informant from unidentified local people. He has further submitted that the petitioners shall present themselves before the police or the court, as the case may be, as and when required, if granted privilege of anticipatory bail.

Considering the submissions as above, this application is allowed. Let petitioners above-named in the event of their arrest/surrender within four weeks from today in the court below be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Narari Kala Khurd P.S. Case No. 05 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the police/court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
