Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 406, 409, and 420 of the Indian Penal Code.

By order dated 23-4-2024 passed by a learned Coordinate Bench, a report was called for from the District Magistrate, Munger with regard to the fact that as to whether the work has been completed under the scheme "Chief Minister Nal Jal Yojana" of Rs. 8,39,000/- or not, but today when the case is taken, no report of District Magistrate is on record. The Court will not wait endlessly for the report of District Magistrate.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and have been falsely implicated in the instant case by the informant with an allegation that petitioners misappropriated an amount of Rs. 8,39,000/- which was given to them under the Nal Jal Yojna. 5.

Learned counsel for the petitioners submits that from perusal of the MB book, it would manifest that petitioners completed the work of Nal Jal Yojna to a tune of Rs. 5,18,664/- and deposited an amount of Rs. 3,18,000/- to the Panchayat Secretary of Matadih Gram Panchayat by cheque. It is also submitted that petitioners will not abscond rather will cooperate in the investigation.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Dharahra
