This is an application for bail in connection with Barachatti P.S.Case No. 200 of 2017 registered for the offences punishable under Sections 363/34, 365 and 376(D) of the Indian Penal Code.
Allegation against the petitioners is of abducting a girl and committing rape upon her.
It has been submitted on behalf of the petitioners that during investigation it has come that there was love affairs between the girl and the petitioner No.1 and the girl has gone out of her sweet will. It has further been submitted that doctor has not found any sign of rape on the person of victim and petitioners are in custody for more than three months.
Patna High Court Cr.Misc. No.29728 of 2017 (3) dt.24-07-2017 2/2 Heard learned APP also.
Having heard both sides and in view of serious nature of allegation, I am not inclined to grant bail to the petitioners. Prayer for bail is rejected.
However, let trial be expedited.
