The petitioner is apprehending his arrest in connection with Barun P.S.Case nO.97 of 2018 , registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 332, 333, 353, 395, 436, 504,120(B) of the Indian Penal Code. Allegation as per FIR is that 80 persons were named in the FIR and 300 persons were protesting against the death of a boy and damaged the public property and set the truck on fire. Submission of the learned counsel for the petitioner is that though the petitioner is named in the FIR and nothing specific has been attributed against him.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named,

Patna High Court CR. MISC. No.17208 of 2019(2) dt.01-04-2019 2/2 in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad in connection with Barun P.S.Case no.97 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid direction, this application is allowed.
