For directing the respondents to approve and disburse the amount of the already approved Housing New House Advance Approval Loan by the Deputy Secretary of the Government, Department of Finance, Government of Bihar, Patna (Respondent No.3) vide Memo No.

711 dated 28.11.2022 as per the New House Advance Approval Rules of the State Government to the tune

Patna High Court CWJC No.4910 of 2023(2) dt.01-11-2023 2/3 of Rs. 10,00,000/- to the petitioner with immediate effect for building the house considering the fact that the first instalment to the tune of Rs.

5,00,000/- has already been sent by the HRMS on the ID of Respondent No. 4, for the withdrawal approval which has been kept in abeyance without any rhyme or reason and thus is pending for the disbursement.

ii. For imposing the heavy costs on the respondents to be paid to the petitioner for suffering the economical, physical, mental, social and emotional agony caused due to the ignorant, non-responsive and lackadaisical approach of the respondents towards the repeated requests of the petitioner for the approval and disbursal of the amount of the already approved New House Advance Approval Loan which shows mala-fide intent of the Respondents inferred from the arbitrary and colourable exercise of their power."

At the outset, the learned counsel for the petitioner submits that he has already received the first installment to the tune of Rs. 5,00,000/- and

Patna High Court CWJC No.4910 of 2023(2) dt.01-11-2023 3/3 for payment of the remaining amount, the petitioner be granted liberty to approach the respondent authorities. Liberty, so sought, is granted.

The writ petition stands disposed off.
