Learned counsel for the petitioner has initially submitted that when the Superintending Engineer in the impugned order has asked the petitioner to make agreement with retrospective effect, the same has to be essentially held to be bad. This Court has very carefully perused the impugned order and does not find so. As a matter of fact, somehow the petitioner or learned counsel for the petitioner have read the word

used in the last paragraph as 'retrospectively'.

In that view of the matter, learned counsel for the petitioner now does not intend to press this application. That being so, this application is dismissed as not pressed.
