The petitioner seeks bail in a case registered for offences under Sections 341, 326 and 307/34 and Section 37(b) (c) of the Bihar Liquor Prohibition and Excise Act, 2016. It is contended that, as per allegation, there was scuffle between the son of the informant and the petitioner in which the petitioner in a drunken state has assaulted him by knife on the back, neck and chest causing grievous injury. It is further contended that there was no repetition of blow and the occurrence is outcome of spur of moment. Petitioner claims that

Considering the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-divisional Judicial Magistrate, Pupri at Sitamarhi in connection with Pupri P.S. Case No. 99 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
