JUSTICE ARVIND SRIVASTAVA ORAL ORDER 13-09-2017 Heard learned counsels for the petitioner and the State. Petitioner seeks bail in connection with Aurari P.S. Case No. 87 of 2017 registered for the offence punishable under section 302 of the Indian Penal Code.

Learned counsels appearing for the petitioner submits that petitioner is neither named in the first information report nor anything has been recovered from his possession. During investigation, witnesses have said that petitioner was seen near the place of occurrence, and due to that only, suspicion has been raised against this petitioner. Except suspicion, there is nothing against this petitioner. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case and the submissions of advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail
