The petitioner is languishing in custody since 2.2.2019 in a case registered for the offences punishable under Sections 30(a) and 37(c) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case is that from the possession of the petitioner, 21 litres of country made liquor was recovered. It is submitted by learned counsel for the petitioner that the petitioner has falsely been roped in this case and recovery has been made from an open area. Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP submits that recovery has been made from the petitioner.
