The petitioner seeks bail in connection with Runnisaidpur P.S Case No. 34 of 2018 registered for the offences punishable under Sections 467, 468, 471, 420 of the Indian Penal Code.
Allegedly, the petitioner got himself appointed on compassionate ground on the post of Class-IV after producing forged certificate.
Submission is of false implication, the petitioner was appointed on the basis of certificate issued to the petitioner, he has not committed any forgery in the certificate. The petitioner has not committed any forgery intentionally, without any fault the petitioner is suffering in custody since 31.03.2018,
Patna High Court Cr.Misc. No.37011 of 2018(2) dt.28-06-2018 2/2 he has already been removed from service, he has got no criminal antecedent, there is no chance of tampering with the prosecution evidence and, as such, the petitioner deserves sympathetic consideration.
Learned A.P.P. submits that the certificate produced by the petitioner was found not correct after verification. In the facts and circumstances stated above, considering the custody of the petitioner now the petitioner is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Runnisaidpur P.S. Case No. 34 of 2018, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
