The petitioner seeks bail in connection with Ghorasahan (Jharaukhar) P.S. Case No.431 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act. The accusation is that in course of patrolling duty by the informant and other police personnel, one persons was seen carrying two sacks, keeping the liquor, loaded on the bicycle, while two persons were pushing the bicycle. On seeing the police party, all started to flee away leaving the bicycle. However, one person was apprehended, whereas other two persons succeeded to flee away. The apprehended person disclosed his name as Aslam Alam, who also disclosed the name of his two associates, who succeeded to flee away, as Tahid

Submission is that the petitioner has no criminal antecedent and is in custody since 01.02.2020. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, East Champaran, Motihari, in connection with Ghorasahan (Jharaukhar) P.S. Case No.431 of 2019.
