2. The petitioner has preferred this application for grant of regular bail in connection with Sheikhpura Cyber P.S. Case No. 23 of 2024 dated 23.06.2024 registered for the offences punishable u/ss 419, 420 and 468 of the Indian Penal Code and Section 66C and 66D of the I.T. Act.

3. As per the prosecution case, upon information that the petitioner is indulged in cyber crime, his mobile was put on surveillance. Subsequently, on the basis of the mobile location, a raid was conducted at the petitioner's house and two mobile phones were recovered from his possession. However, mobile which was used in committing the Cyber fraud was not

Patna High Court CR. MISC. No.15367 of 2025(3) dt.14-05-2025 2/3 recovered. Upon asking the petitioner about the said mobile, he said that the same were destroyed and the other mobiles were seized.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Learned counsel has further submitted that as per the F.I.R., Cyber crime was committed by mobile number 7903696864 but the same was not recovered from the conscious possession of the petitioner. It is further submitted that the seized mobiles are the petitioner's own mobiles and the said mobiles did not contain any objectionable material. The petitioner has no concern with the alleged offence. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 24.06.2024.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that the bail application of the petitioner was earlier rejected by a Coordinate Bench of this court vide order dated 21.11.2024 passed in Cr. Misc. No. 58688/2024. Learned counsel has further submitted that the petitioner was indulged in the Cyber crime.

6. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.15367 of 2025(3) dt.14-05-2025 3/3 of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sheikhpura in connection with Shiekhpura Cyber P.S. Case No. 23 of 2024 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.

7. The application stands allowed.
