The learned counsel for the petitioner submits that the present contempt application has been filed alleging violation of the order dated 14.10.2019 in C.W.J.C. No. 20449 of 2019 whereby the respondents were directed to verify the records to ascertain whether the petitioner has worked as Night Guard or not for the period he is claiming salary and in the event, if it is found that the petitioner has worked for the period which he is claiming salary, then the respondent shall ensure payment of

Patna High Court MJC No. 778 of 2020(4) dt.21-03-2023 2/2 salary for that period.

The learned counsel for the State submits that a show cause has been filed on behalf of the O.P Nos. 2, 3 and 5 and from perusal of Annexure-A, it would manifest that the District Programme Officer, Jamui has passed a reasoned order dated 17.01.2020/31.01.2020 wherein it has been specifically recorded that the petitioner has never worked as Night Guard. In view of the show cause filed on behalf of the O.P Nos. 2, 3 and 5, the Court is not inclined to proceed with the contempt application.

Accordingly, the present contempt application stands dismissed.
