Petitioner apprehends arrest in connection with Naubatpur P.S. Case No 94 of 2018 registered for the offence punishable under sections 30(a), 38 (i) and 41 (i) of the Bihar Prohibition and Excise Act.
Learned counsel appearing for the petitioner submits that the petitioner has been implicated in the present case on the basis of confessional statement of co-accused Ashok Kumar. The said Ashok Kumar is on bail. Nothing has been recovered from the conscious possession of this petitioner. Petitioner is a man of clean antecedent.
Considering the facts and circumstances of the case
Patna High Court Cr.Misc. No.34884 of 2018(2) dt.19-06-2018 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Naubatpur P.S. Case No. 94 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
