JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends her arrest in connection with Sabour Police Station Case No. 30 of 2015 registered for the offences punishable under Section 304B, 120B, 328, 201 of the Indian Penal Code.
Petitioner happens to be Gotni of the deceased and the informant leveled allegation against the petitioner of having illicit relation with the husband of the deceased.
Learned counsel appearing for the petitioner submits that petitioner is living separate from the husband of the deceased and moreover, co-accused Jhuniya Devi, who happens to be married sister-in-law of the deceased, have already been granted
Patna High Court Cr.Misc. No.24607 of 2015 (2) dt.10-07-2015 2/2 privilege of anticipatory bail by a co-ordinate Bench of this Court. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of her arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Bhagalpur in Sabour Police Station Case No. 30 of 2015, subject to condition as laid down under Section 438(2) of the Cr.P.C.
