1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner has preferred this application for grant of regular bail in connection with Jaipur P.S. Case no. 79 of 2023 registered under section 306 of the Indian Penal Code.
3. As per the prosecution case, the informant states that his daughter was married to the petitioner herein. On 24.10.2023 while his wife was talking to her daughter, she disconnected her phone stating that her husband was calling. The informant further states that the son-in-law was working privately in Delhi. He was having some extra marital

To save himself his son-in-law used to make counter allegations about his daughter having extra marital relations with another boy. The informant further states that on 24.10.2023 at about 1:30 P.M he received information about the death of his daughter by hanging.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case only for the reason of his being the husband of the deceased. The daughter of the informant committed suicide which would be evident from the contents of the F.I.R as also the F.I.R being registered under 306 of the Indian Penal Code only. Further referring to the contents of the F.I.R it is submitted that the petitioner was in Delhi at the relevant time. The petitioner is in custody since 28.11.2023, has no criminal antecedent and charge-sheet has been submitted in the case.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R, his being in custody for four months since 28.11.2023, his not having any criminal antecedent and charge-sheet having

Case no. 79 of 2023, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate- 1st Class, Banka.
