The petitioner seeks regular bail in connection with Chhatapur P.S. Case No. 370 of 2018, registered for the offence punishable under Sections 401, 413, 414, 34 of the Indian Penal Code.

The allegation is regarding recovery of a stolen motorcycle from the petitioner herein.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case on the confessional statement made by the co-accused Santosh Sardar. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 29.12.2018. Lastly, it is submitted that the co-accused,

No.17149 of 2019(2) dt.01-04-2019 2/2 namely, Binod Sardar has already been granted bail by an order dated 28.03.2019 passed by a coordinate Bench of this Court in Criminal Miscellaneous No. 18945 of 2019. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IVth, Supaul in connection with Chhatapur P.S. Case No. 370 of 2018.
