2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 103(1), 238 and 3(5) of the Bhartiya Nyay Sanhita, 2023.

3. The case of the prosecution is that when the informant came to her house she found that her daughter namely, Ankita Kumari was hanging, she started crying. It is alleged that the petitioner along with others arrived there and took away the dead body and concealed it. It is further alleged that the dead body could not be found, then the case was filed.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Petitioner is seventy years

Patna High Court CR. MISC. No.16153 of 2025(2) dt.11-04-2025 2/2 old and he is cousin father-in-law (Chachera Sasur) of the informant. It has also been submitted that the informant has filed a petition before the trial Court that she has not filed the case rather her signature was taken on a plain paper. She has not named anybody. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 05.01.2025.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Birpur P.S. Case No. 233 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.F.C.-cum-A.M., Begusarai.
