2. In this present case, the petitioners are apprehending their arrest in connection with Baghaila P.S. Case No. 203 of 2024, registered on 24.11.2024 for the offences under Sections 127(1), 115(2), 118(1), 117(2), 74, 352 and 351(2) of the B.N.S.
3. Learned counsel for the petitioners seeks permission to withdraw the present petition with prayer that his case may be considered in the light of judgment in the case on Naushad Ansari vs. State of Bihar (CR. Misc. No. 3536 of 2024) since the punishment for the offences is less than seven
Patna High Court CR. MISC. No.17797 of 2025(2) dt.02-04-2025 2/2 years.
4. Permission is accorded.
5. Accordingly, the petition is dismissed as withdrawn in the light of decision of this Court in the case of Naushad Ansari (Supra) as well as the guidelines issued by the Hon'ble Supreme Court in the case of Mohd. Asfak Alam vs. State of Jharkhand, reported in (2023)8 SCC 632.
6. The authorities concerned are directed to strictly obey all the guidelines issued in the aforementioned cases. (Arun Kumar Jha, J) balmukund/- U T
