Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Dehri (M) P.S. Case No. 148 of 2021 registered on 26.11.2021 lodged under Sections 302 and 34 of the Indian Penal Code read with Section 27 of the Arms Act.
Learned counsel for the petitioner submits that vide order dated 15.09.2022, passed in Cr. Misc. No. 23828 of 2022 in regular bail application of the petitioner was rejected. He submits that petitioner is custody for one year and seven months. Counsel further submits that charge has been framed
Patna High Court CR. MISC. No.21991 of 2023(3) dt.21-06-2023 2/2 and prosecution witness have started.
Counsel for the State opposes the prayer for bail. Counsel for the Informant submits that petitioner is the main conspirator and the arms used in the crime has been recovered from the information disclosed by the petitioner and other accused persons.
In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner.
With this observation, the bail application stands rejected.
