In this application for anticipatory bail the petitioner apprehends his arrest for the offence punishable under sections 302/34 of the I.P.C.

Allegedly, the petitioner took away Krishna @ Sunil Das, son of the informant and in the night on the ambulance son of the informant was brought in dead condition and it is stated that the petitioner along with others had killed her son. Submission is of false implication and further that only on suspicion the petitioner has been implicated. There is no direct evidence to which the learned A.P.P. opposes. Considering that the petitioner has taken away the deceased and thereafter his dead body was brought and as such

Patna High Court Cr.Misc. No.30942 of 2014 (2) dt.28-01-2015 2/2 finding it not a fit case for pre-arrest bail, the prayer for pre-arrest bail of the petitioner stands rejected in connection with Akbarnagar P.S. Case No. 18 of 2014 pending in the Court of C.J.M. Bhagalpur.
