Having regard to the fact that the petitioner has a grievance with regard to her being not allowed to make her attendance, the remedy for the petitioner, instead of going to the Collector, who has got no authority under the Municipal Law, was to approach the Executive Officer, the head of the establishment of Nagar Parishad.
As a matter of fact, learned counsel appearing on behalf of the Arwal Nagar Parishad has also informed this Court that he has been orally instructed that the petitioner has never been regular in attending her duty and, as such, there was no question of allowing to make her attendance.
Patna High Court CWJC No.9029 of 2015 (2) dt.29-06-2015 These are the routine administrative matter and such complaint of an employee alike the petitioner should be examined by the head of the establishment, namely, Executive Officer, Arwal Nagar Parishad.
In that view of the matter, this writ application is disposed of with a direction to the Executive Officer, Arwal Nagar Parishad to examine the grievance of the petitioner and take an appropriate decision as is permissible in law. With the aforementioned observation and direction, this application is disposed of.
