JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks pre-arrest bail in connection with Madhuban P. S. Case No. 23 of 2018 registered under Sections 188, 420 & 379 of the Indian Penal Code and under Section 4/40 of the Bihar Minor Mineral Concession Act, 1972. It is submitted by the learned counsel for the petitioner that the involvement of the petitioner in the alleged offence of carrying sand is based merely on the ground that he is owner of the truck in question on which sand was being carried. It is submitted that the petitioner has got no criminal antecedent and having got roots in the society, he is not likely to abscond or tamper with the evidence, if released on bail.

No.35303 of 2018 (2) dt.28-06-2018 2/2 Considering the nature of allegation and submissions made above, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-IV, East Champaran at Motihari in Madhuban P. S. Case No. 23 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
