The petitioner, who is in custody, seeks bail in connection with Sheikhpura (Siari) P.S. Case No. 276 of 2018 registered for the offence punishable under Section 366/34 of the Indian Penal Code.

Informant is the father of the victim girl, who in his written complaint has alleged that his daughter Nisha Kumari aged about 18 years was married to Rohit Kumar on 26.04.2018. On 01.05.2018 she went to the market for stitching suit and thereafter she did not return and even after much search she was not traced. He has further alleged that Raushan Kumar (petitioner) and three persons named in the FIR had

Patna High Court Cr.Misc. No.40178 of 2018(2) dt.12-07-2018 2/2 kidnapped his daughter. The girl was recovered by the police and her statement was recorded under Section 164 of Cr.P.C. contained in Annexure-2 to this writ petition in which she has stated that she had gone with Raushan Kumar (petitioner) on her own sweet will and volition. Petitioner has no criminal antecedent and he is in custody since 11.05.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura, in connection with Sheikhpura (Siari) P.S.
