Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34, 120B of the Indian Penal Code as well as Section 27 of the Arms Act. According to FIR co-accused Rewati Ranjan fired causing injury at the chest of the husband of the informant whereas this petitioner caused firearm injury at the waist. Submission is that the Doctor has found single wound of entry at the chest which is attributed against co-accused. Allegation against the petitioner is not corroborated by medical evidence. Petitioner is in custody since 29.04.2017. Considering the period already undergone by the petitioner and the fact that the allegation is not corroborated by the

No.35499 of 2018 (2) dt.26-06-2018 2/2 medical evidence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 294 of 2017 arising out of Nayaram Nagar Police Station Case No. 77 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
