The present application has been filed for quashing the entire proceeding of the Complaint Case No. 1072 of 2008 passed by Judicial Magistrate, 1st Class, Purnea including its last order dated 29.04.2015, which is a formal order. It appears from the order dated 12.11.2014, that after the charges being framed the trial was at the stage of evidence.

There is nothing on record to suggest the present stage of trial.

The complaint was filed in 2008 but the present

Patna High Court Cr.Misc. No.24174 of 2015 (2) dt.24-04-2017 2/2 quashing petition was filed after seven years of filing of complaint. In the circumstances, this application is disposed of with liberty to the petitioners to raise all the contentions during trial, if it has not been concluded as yet.
