2. In this case, the petitioner is seeking regular bail in connection with Nawada Muffasil P.S. Case No. 84 of 2023, registered for the offences punishable under Sections 366A of Indian Penal Code and also later on added Section 8/12 of POCSO Act.
3. As per allegation, the petitioner kidnapped the minor daughter of the informant for the purpose of marriage.
4. At the very outset, the learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The victim did not support the case in her Statement under Section 164 of the CrPC. She has specifically stated that she has solemnized marriage with the petitioner and she has also a child from the petitioner.
5. On the other hand, learned APP, Mr. Shailendra
Patna High Court CR. MISC. No.21262 of 2024(3) dt.01-07-2024 2/2 Kumar has opposed the prayer for bail.
6. Considering the above-mentioned facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.D.J.-VI, Nawada in connection with Nawada Muffasil P.S. Case No. 84 of 2023, subject to the following condition:- The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
