Petitioner seeks bail in a case registered for the offence punishable under Section 365 of the Indian Penal Code. According to FIR, the informant was sleeping in her house along with her baby in lap. The baby got missing, hence, FIR was lodged against unknown.

Submission is that soon after the occurrence restatement of the informant and statement of other family members was recorded by the police but none suspected against anyone. Again statement of the victim was recorded after five months where she stated that villagers are saying that the petitioner is issueless, hence, he might have committed kidnapping.
