Petitioner seeks bail in a case registered for the offence punishable under Section 365 of the Indian Penal Code. According to FIR, the informant was sleeping in her house along with her baby in lap. The baby got missing, hence, FIR was lodged against unknown.
Submission is that soon after the occurrence restatement of the informant and statement of other family members was recorded by the police but none suspected against anyone. Again statement of the victim was recorded after five months where she stated that villagers are saying that the petitioner is issueless, hence, he might have committed kidnapping. Considering the nature of material, let the

No.37660 of 2018 (2) dt.06-07-2018 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kateya Police Station Case No. 89 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
