Heard Mr. Yogesh Chandra Verma, the learned Sr. Counsel for the petitioner and learned APP for the State. The petitioner apprehends his arrest for the offences alleged under Sections 409/34 of the Indian Penal Code, registered in connection with Kinjer P.S.Case No. 01 of 2021.

As per allegation, the petitioner, who is a retired clerk of Mahabir High School, Jhunathi, Karpi, Arwal did not hand over the charge of the documents and other properties belonging to the school.

No.26678 of 2021(2) dt.09-03-2022 2/3 The learned Senior Counsel, by drawing my attention towards Annexue-2, has submitted that already the charge of all the liabilities has been handed over by the petitioner on 19.08.2019 to the informant and the xerox copy of the charge report has been annexed as Annexure-2. In paragraph No 8 of the bail petition, the petitioner has mentioned that he retired on 31.01.2019 and handed over the entire financial and nonfinancial school records to the informant on 19.08.2019. By filing Annexure-3, 4, 5 and 6, the learned Senior Counsel has submitted further that the school administration was delaying in issuance of no objection certificate in favour of the petitioner. He has sent letters to the higher authorities.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM III, Arwal in connection with Kinjer P.S.Case No.01 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided
