JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the State. The petitioner is an accused in Bihta P.S. Case No. 863 of 2016 for the offence under sections 147, 148, 149, 307 and 504 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner is in custody since 30.5.2017. Allegation against the petitioner in the FIR is similar to that of other co-accused, namely, Pradeep Kumar, Pintu Singh, Arvind Singh, Ranjan Kumar, Anil Pandey, Arun Pandey, Mritunjay Kumar Raj, Subhash Kumar, Dheeraj Kumar, Chunu Pandey, Deepak Pandey, Vijay Singh, Bandhu Singh and Pintu Pandey being members of the unlawful assembly, equipped with arms.

From perusal of Annexures-6 to 9, it appears that other co-accused named in this case along with the petitioner,

Patna High Court Cr.Misc. No.35817 of 2017 (2) dt.10-08-2017 2/2 namely, Chunu Pandey has been granted bail by this court in Cr. Misc. No. 2168 of 2017 vide order dated 30.1.2017, Dipak Pandey has been granted bail by this court in Cr. Misc. No. 11319 of 2017 vide order dated 18.04.2017 and Pradeep Kumar has been granted bail by this court in Cr. Misc. No. 15518 of 2017 vide order dated 16.05.2017 whereas Ravindra Singh @ Ravindra Kumar Singh was granted anticipatory bail vide order dated 01.07.2017 in Cr. Misc. No. 17883 of 2017.

Considering the fact that allegation against this petitioner is similar to that of other co-accused, have been granted regular bail or anticipatory bail by this court in various criminal miscellaneous numbers as mentioned above, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Danapur, in connection with Bihta P.S. Case No. 863 of 2016 on the condition that the petitioner will extend full cooperation in the trial and will not, in any manner, tamper the evidence or influence the witnesses.
